DOL slams California’s investigation of whistleblower complaints

A report issued by the U.S. Department of Labor criticized California state labor officials for shoddy investigations of complaints of whistleblower retaliation.  The report “faulted investigators for failing to record interviews, analyze evidence, organize case files and close cases in time.”

In more than half of the cases reviewed in the audit, investigators did not interview the person who submitted the whistleblower complaint. Investigators frequently didn’t interview other witnesses either and sometimes simply accepted a company’s defense.

Unfortunately, the federal government itself is guilty of the same offenses in its “investigation” of  retaliation complaints filed by its own whistleblowing employees.

The California Department of Industrial Relations has not yet made an official response to the DOL review.  Clearly, it has a lot of explaining to do.
